DECC to Appeal High Court Ruling
The Department of Energy and Climate Change (DECC) has applied to the Court of Appeal to challenge last month’s ruling that the propsed changes to the Feed-in-Tariff (FiT) are unlawful. If this is successful the DECC will be able to appeal in court on January 13th. The results from this will likely be announced the week after. Following this it is expected that at the end of this month the DECC will announce its response to the consultation period, which was up to December 23rd last year.
As it is unclear what this wil mean for the FiT, the DECC have issued the following statement:
“The tariff rate for PV installations less than or equal to 4kW will not fall below 21p for installations with an eligibility date between 12th December 2011 and March 31 2012”
Concerns are mounting within the solar panel industry that the FiT may drop lower than 21p after March 31st due to the higher than expected demand before December 12th. However the above statement from the DECC at least helps to clarify the FiT rate for installs in place before the end of March.
